    Sure, african-americans being provided subpar education certainly violates the clear meaning of the equal protection clause.

    This is just one example that is the easiest to point to, there are dozens of examples in this book of the author heralding correct decisions by the supreme court when the result is morally desorable, despite its legal basis being just as dubious as the opinions of the activist court (as he calls the court from 1960 to today).
